И. On Introduction Changes in the Composition of the Interministerial Commission on Climate Change.

Pursuant to Item 6 of Provisions on the Interministerial Commission on Climate Change and taking into account the proposal of the National Academy of Sciences of Ukraine (NASU) to appoint the Institute of Energy of the NASU а central research-supporting institution for developing proposals and materials aimed at Ukraineъs compliance with its commitments as а Party to the UN Framework Convention on Climate Change. The Commission Chairman made а decision on inclusion of S. Titenko, State Deputy Secretary of the Ministry of Fuel and Energy, I. Kuleba, State Deputy Secretary of the Ministry of Foreign Affairs, M. Kulyk, Director of the Institute of Energy of the NASU, P. Kovalenko, Academician-secretary of the Agriculture Division of the Ukrainian Academy of Agrarian Sciences in the Interministerial Commission and on withdrawal of M. Rul and O. Berezhny from the Interministerial Commission.

The Interministerial Commission decided:
1. To take into consideration information about introduction of changes made by the Interministerial Commission Chairman in the commission composition.
2. To charge S. Kurykin, the First Deputy Chairman of the Ministerial Commission, Minister of Ecology and Natural Resources of Ukraine with studying in the course of work with I. Rizak, the Chairman of Verkhovna Rada Committee of Ukraine on Environmental Policy, Nature Management and Liquidation of Chernobyl Catastrophe Consequences an issue concerning the inclusion of the Committee representative in the Interministerial Commission.

II. On Appointing а Research-supporting Institution for Developing Proposals and Materials Aimed at Ukraineъs Compliance with Its Commitments as а Party to the UN Framework Convention on Climate Change.

In fulfillment of the Interministerial Commission decision (Minutes No. 10 of 01.10.02, item Ии,5) the NASU with due account of capabilities of institutes and other institutions of the NASU proposed to appoint the Institute of Energy of the NASU а central research-supporting institution for ensuring Ukraineъs compliance with its commitments as а Party to the UN Framework Convention on Climate Change and developing measures on the preparation of materials regarding the Kyoto Protocol ratification.

The Interministerial Commission decided:
1. To support the proposal of the NASU to appoint the Institute of Energy of the NASU а central research-supporting institution for ensuring Ukraineъs compliance with its commitments as а Party to the UN Framework Convention on Climate Change and developing measures on the preparation of materials regarding the ratification of the Kyoto Protocol under direct coordination of these efforts by the MENR. To stipulate the involvement of other research institutions of the NASU, MENR and other research organizations in necessary surveys.
2. To recommend that the Institute of Energy of the NASU should envisage in its action plans the surveys and preparation of materials on climate change as agreed-upon with the MENR.

IІІ. On Advisability for Ukraine to Ratify the Kyoto Protocol and Implement Necessary Measures on Fulfillment of Decisions Made by the 7th Conference of the Parties to the UN Framework Convention on Climate Change.

In fulfillment of the Interministerial Commission decision (Minutes No. 10 of 01.10.02, item Ии,2) the MENR summarized proposals and comments received from ministries and other central executive bodies on implementation of necessary measures to fulfill decisions of the 7th Conference of the Parties to the UN Framework Convention on Climate Change and advisability of the Kyoto Protocol ratification by Ukraine.

According to conclusions of the Ministry of Economy, Ministry of Finance and Ministry of Industrial Policy, ratification of the Kyoto Protocol by Ukraine is premature, since mechanisms of its implementation, specifically the international emissions trading, is extremely complex and require additional study, substantiation of legal, economic and social impacts resulted from the joint implementation mechanism under conditions of the actual economic situation in Ukraine. At the same time, it is necessary to analyze the ways of addressing issues both at the national and international levels.
In its conclusion, the Ministry of Economy drew attention to the uncertainty of the future production structure and rates of its improvement, which complicates the determination of the amount of credits in prospect. At that, it should be taken into account the lack of sufficiently sound predictions of development of relevant industries, which must be the basis of calculations.

According to conclusions of the State Committee for Energy Conservation, Ministry of Transport, Ministry of Fuel and Energy and Ministry of Foreign Affairs, ratification of the Kyoto Protocol is advisable on conditions of development and introduction of transparent mechanisms and procedures for fulfillment of its commitments and with allowance for results of the analysis of financial and economic impacts on Ukraine.

According to MENR conclusions, ratification of the Kyoto Protocol by Ukraine is environmentally advisable, which necessitates the development of а relevant Action Plan on preparation of required documents and draft decisions concerning the ratification of the Kyoto Protocol and fulfillment by Ukraine of requirements of the UN Framework Convention on Climate Change. At the same time, the MENR states that the Protocol Parties voluntarily use or do not use the mechanisms stipulated by the Kyoto Protocol for greenhouse gas emission reduction, including Erus trading.

The Interministerial Commission decided:
1. To agree with the MENR proposal on environmental advisability of the Kyoto Protocol ratification by Ukraine, its consistency with the principles of sustainable development.

2. To charge the MENR, Ministry of Economy, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Fuel and Energy, Ministry of Industrial Policy, Ministry of Transport, State Committee for Energy Conservation and other executive bodies concerned to prepare а draft Action Plan on possible participation of Ukraine in the Kyoto Protocol to the UN Framework Convention on Climate Change and carry out additional analysis of potential advantages and disadvantages of Ukraineъs participation in the Kyoto Protocol mechanisms.

3. To charge the MENR, Ministry of Economy, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Fuel and Energy, Ministry of Industrial Policy, Ministry of Transport, State Committee for Energy Conservation and other executive bodies concerned to develop, within two weeks, and submit their proposals regarding the list of measures required for the Kyoto Protocol ratification.
To include in the Action Plan, specifically, the following:
The Ministry of Economy - necessary substantiations on predictions of macroeconomic indicators of development of key industries of the economy by 2020, and economic mechanisms to regulate the amounts of greenhouse gas emissions;
The Ministry of Fuel and Energy - necessary substantiations of the fuel-energy complex development by 2020 and predictions of its impact on climate change;
The Ministry of Industrial Policy - necessary substantiations of the industrial sector development by 2020 and predictions of its impact on climate change;
State Committee for Energy Conservation - proposals on introduction of energy conservation and energy efficiency measures with the purpose of reducing greenhouse gas emissions.

4. The Ministry of Ecology and Natural Resources should, with due account of proposals submitted by ministries and other concerned central executive bodies, prepare а draft Action Plan regarding the preparation of Ukraineъs participation in the Kyoto Protocol for its consideration and approval at the next meeting of the Interministerial Commission. Deadline: 09.01.2002.

5. To entrust the Institute of Energy of the NASU with preparing, on the basis of proposals submitted by ministries and other concerned central executive bodies, necessary documents on the Kyoto Protocol ratification by Ukraine for their consideration at the Interministerial Commission meeting. Possible terms for preparing these papers: by 09.01.2002.


IV. On Tentative Terms of Holding the Next Meeting of the Interministerial Commission.

The Interministerial Commission decided:
1. To hold the next meeting of the Interministerial Commission within the period from October 1 to 15, 2002.
