On Interministerial Commission
on Climate Change

Seeking to arrange development and coordinate implementation of the national strategy and the national plan of actions on Ukraineús commitments under the UN Climate Change Framework Convention and the Kyoto Protocol thereto, the Cabinet of Ministers of Ukraine orders to:

1. Create an Interministerial Commission to meet obligations under the UN Framework Convention on Climate Change consisting of the members as listed in the Appendix.

2. Approve the Mandate of the Interministerial Commission to meet obligations under the UN Climate Change Framework Convention (enclosed herein).

Mandate
of Interministerial Commission for
Execution of UN Climate Change Framework Convention

1. Creation of the Interministerial Commission (hereinafter referred to as "the Commission") has an objective to arrange development and coordinate implementation of the national strategy and the national action plan to fulfill Ukraineús commitments under the UN Climate Change Framework Convention (hereinafter referred to as "the UN Framework Convention") and the Kyoto Protocol thereto.

2. In its activities, the Commission shall follow the Constitution of Ukraine, Ukrainian laws, acts by the Cabinet of Ministers and the President of Ukraine, these Provisions and resolutions by the Conference of Parties to the UN Framework Convention.

3. The Commission shall interact with relevant committees in the Supreme Rada of Ukraine, ministries, other central and local executive power bodies, enterprises, institutions and organizations.

4. The Commission shall have its major tasks which are to:

- arrange development of the national strategy and the national action plan to fulfill Ukraineús commitments under the UN Framework Convention and the Kyoto Protocol thereto;

- coordinate activities of ministries, other central and local executive power bodies, enterprises, institutions and organizations on implementation of the national action plan to fulfill Ukraineús commitments under the UN Framework Convention and the Kyoto Protocol thereto;

- work out proposals regarding implementation of the mechanisms for fulfilling the commitments under the Kyoto Protocol;

- arrange preparation of national notices on execution of the commitments as per the UN Framework Convention;

- arrange preparation of à national inventory of anthropogenic emissions from sources and absorption of all greenhouse gases by sinks not covered by the Montreal Protocol with regard to the ozone depleting substances;

- control over implementation of the action plan to mitigate climate change consequences by mitigating anthropogenic emissions from sources and absorption of all grrenhouse gases by sinks which are not covered by the aforesaid Montreal Protocol and to promote an adequate adaptation to climate changes;

- review the UN Framework Convention and Kyoto Protocol materials that come from international governments, Global Environmental Facility, World Bank and other international organizations and use them as à basis for preparation of relevant proposals.

5. The Commission shall be entitled to:

- present proposals, as required, on issues within its jurisdiction;

- obtain information needed to perform the tasks assigned, as required, from central and local executive power bodies, enterprises, institutions and organizations;

- create expert panels and working groups to help fulfill the tasks assigned to the Commission and attract employees of central and local executive power bodies and professionals from research and other institutions (upon their supervisors' consent) to participate in the work.

6. The Commission shall be directed by à Chairman who will have two deputies. The Chairman shall be in charge of meetings, control over fulfillment of decisions made, coordination of the Commissionús cooperation with relevant executive bodies of the UN Framework Convention and the Kyoto Protocol thereto.

The Commission Chairman shall be authorized to change the membership of the Commission.

7. The Minekobezpeky shall be responsible for logistical support to the Commission.

8. Meetings shall be the primary form of the Commissionús work that shall be held as per the work plan approved by the Chairman or if necessary.

A Commission meeting shall be deemed valid if attended by no less than à half of the members.

A decision by the Commission shall be deemed as adopted if voted for by more than à half of the members attending the meeting.

Decisions by the Commission shall be executed with the minutes signed by the Commission Chairman or, if absent, by his deputy.
